1. AGREEMENT TO OUR LEGAL TERMS We are Tashcolour Tmi, operated by Tatiana Shakhovskaia (Company, we, us, or our), a company registered in Finland at Tikkakalliontie 231, LAHTI, Päijät-Häme 15820 . Our Business ID (Y-tunnus) is 3451369-9 and our VAT number is FI34513699. We operate the website https://tashcolour.store/ (the Site) and provide services involving the sale of original paintings, drawings, and handmade art (the Products). By accessing the Site or purchasing Products, you agree to be bound by these Terms and represent that you are at least 18 years of age. If you do not agree, you must cease use of the Site immediately.

2. PRODUCTS, ARTISTIC VARIATION, AND ORDERS

The Site offers original artworks.

·         Artistic Nature: You acknowledge that handmade art is unique. Minor variations in texture, color, and brushwork compared to digital photographs are not considered defects but characteristics of the Product.

·         Display: We make every effort to display colors accurately, but we cannot guarantee that your device's display will reflect the exact tones of the physical artwork.

·         Availability: Orders are subject to availability. We reserve the right to limit sales to any person or geographic region and to refuse any order.

3. PURCHASES AND PAYMENT All payments are processed through secure payment aggregators integrated with Shopify (e.g., Stripe, PayPal).

·         Payment Methods: We accept major credit/debit cards and digital wallets (Apple Pay, Google Pay).

·         Pricing: Prices are inclusive of Finnish VAT where applicable. For international orders (outside the EU), you are the importer of record and are solely responsible for all customs duties, import taxes, and local clearance fees.

4. SHIPPING AND DELIVERY

We ship worldwide.

·         Risk of Loss: For consumers (B2C) in the EU, the risk of loss passes to you upon physical possession of the Product. For all other customers (B2B or outside the EU), risk passes upon delivery to the carrier.

·         Delivery Timeline: We are not liable for delays caused by customs, international postal disruptions, or force majeure events (including but not limited to natural disasters, war, or global infrastructure failure).

5. RIGHT OF WITHDRAWAL AND RETURNS

In accordance with the EU Consumer Rights Directive (2011/83/EU):

·         Ready-made Items: You have 14 days from receipt to cancel your purchase. You must return the item in its original condition. You are responsible for all return shipping and insurance costs.

·         Custom/Commissioned Art: In accordance with Article 16(c), the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. These sales are final.

6. INTELLECTUAL PROPERTY RIGHTS Tashcolour Tmi (Tatiana Shakhovskaia) retains all intellectual property rights to the artworks.

·         No Reproduction: The sale of an artwork transfers physical ownership only. You are strictly prohibited from reproducing, scanning, or commercially exploiting the image of the artwork without a separate written licensing agreement.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by Finnish law:

·         We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or Products.

·         Our total liability shall not exceed the purchase price of the specific Product that gave rise to the claim.

·         We do not guarantee that the Site will be uninterrupted or error-free.

8. DATA PROTECTION AND DSA We process data in accordance with our Privacy Policy and GDPR. In compliance with the EU Digital Services Act (DSA), our point of contact is tashcolour1@gmail.com.

9. SEVERABILITY AND MODIFICATIONS If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. We reserve the right to update these Terms at any time; continued use of the Site constitutes acceptance of the new Terms.

10. GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of Finland.

·         Consumer Disputes: EU consumers may use the Finnish Consumer Disputes Board (www.kuluttajariita.fi) or the EU ODR platform (http://ec.europa.eu/consumers/odr/).

·         Jurisdiction: All disputes shall be settled exclusively in the District Court of Päijät-Häme, Finland.
